HAVEN IN PARIS TERMS AND CONDITIONS
(These are the exact terms you will agree to when signing the Haven in Paris rental agreement to secure your rental).
What you need to do to Secure a Reservation with Haven in Paris
Thank you for your interest in our properties. In order to secure a reservation, we will send a rental agreement with all of the information you need to firm up your booking.
For your information:
- Normally all of our final Euro rates will be converted to US Dollars on the day you reserve. You can see updated currency conversions at www.xe.com/ucc.
- As of February 2009, we now have a EURO account and can accept wires in Euros. For check & credit card payments, however, we only accept US Dollars.
- Our rate is all inclusive, there are no extra taxes or fees.
- If we are more than 2 months before your arrival date, we would require a 50% deposit to book the apartment & the balance will be due 2 months before your arrival.
- If we are less than 2 months before your arrival date, we would require 100% payment to book the apartment.
- We accept checks and Visa, Mastercard, or American Express in $USD, and wire transfers in $USD or EUR.
RENTAL TERMS AND CONDITIONS
Rental period
Rental begins: 4 p.m. on arrival date
- If no one has vacated the Property the morning you arrive, you may check in as early as you like. Please check on the Property calendar or with us closer to your arrival to determine whether someone is leaving that morning.
- In the event that someone has just vacated the Property the morning you arrive, will do our best to accommodate an early check in. Officially check in is 4 pm, nevertheless, your Greeter will meet you at the Property as early as 10 am (sometimes earlier, please ask) to allow you to drop off luggage. At this time, your Greeter will tell you when the maid will be finished and ask you to return at that time. ** Please be aware that maids cannot clean when guests are in the Property.
- If you would like to guarantee that the property is completely cleaned and ready for an early morning arrival, we suggest you reserve the Property from the previous day.
Rental ends: 10 a.m. on departure date
- If your flight/train is later in the day and another group is arriving immediately after you, we will check you out by 10am, arrange for you to leave your luggage, and have you come back while the cleaner is still cleaning.
- If no one is arriving the day you leave, we will be happy to arrange your check out accordingly, but when necessary, the maid may need to arrive as early as 10am to clean.
Early & Late Check In and Check Out
Haven in Paris understands that international flights can sometimes arrive or depart at inconvenient times. We will do our best to accommodate your early and late arrivals and departures. Please note, however, that for any check ins or check outs before 8 am and after 9 pm there will be an extra fee of 30 euros to be paid in CASH to your Greeter in Paris.
Holiday Check In
For arrivals after 4:00 pm on Christmas Eve and New Year's Eve and for arrivals at any time on Christmas Day and New Year's Day, there will be a surcharge to be paid in CASH to your Greeter upon your arrival. Please inquire as to exact rate as it varies by property.
Rental Fee
Rental fees are in $USD converted from euros on the date the contract is initiated by Haven in Paris, at the rates published on www.xe.com/ucc. Renter agrees that all payments will be made in US$ Dollars based on this rate unless payment is being made by wire transfer in Euros.
The rental fee includes:
- Occupancy of the Property for the specified time period.
- Flowers & wine upon arrival.
- All taxes, utilities, and local telephone service.
- Bed linens and towels.
- Guide with detailed local recommendations (in most properties).
- Housecleaning once a week after a week for stays of 2 weeks or longer. (Extra cleaning can be arranged for a fee. Please inquire as far in advance as possible.)
- Concierge Service is available for an extra fee. Please Inquire.
- Phone in Paris:
a. FREE Unlimited calls from Paris to landlines & cell phones in: USA & Canada.
b. FREE Unlimited calls from Paris to landlines in: UK, continental Europe, Australia, & new Zealand.
**Please inquire about phone service to other countries. Some of the apartments have different service providers. If there is a country not listed above that you need to call, please re-confirm to make sure it is indeed free in the Property.
- In France, mobile/cell phones (numbers that start with 06) are quite expensive to call. Calls to 06 numbers are NOT included in the rental price (and will be billed accordingly – please keep track of your minutes spent calling 06 numbers), EXCEPT in the event that you need to reach your greeter on their mobile phone, for which there is no charge.
- In Provence and Tuscany, the villas mainly offer local phone service. Please ask for specific details as these things do evolve.
Payment
If the rental start date is more than two months from date of signing the rental agreement ("RA"):
a. Fifty percent (50%) of the total rental fee is due.
No rental is confirmed until you accept the RA and terms and conditions, and your credit card is charged (or you fax/scan us a copy of a check or wire payment for the appropriate rental fee, which such payment is then promptly sent to Haven in Paris).
Security Deposit
Lastly you must provide a security deposit in the form of a credit card authorization form, a US check sent to HiP, or cash upon arrival. When providing cash or check, the amount of this deposit varies by Property and will be specified on the RA.
b. The balance of the rental fee is due two months before arrival. If the balance has not been paid by this date, we reserve the right to cancel your booking, void your contract, and retain your initial payment.
If the rental start date is less than two months from the date of signing the RA:
One hundred percent (100%) of total rental fee is due.
No rental is confirmed until you accept the RA and terms and conditions, and your credit card is charged (or you send us a copy via fax or scan of your check or wire payment for the appropriate rental fee, which such payment is then promptly sent to Haven in Paris).
Security Deposit
Lastly you must provide a security deposit in the form of a credit card authorization form, a US check sent to HiP, or cash upon arrival. When providing cash or check, the amount of this deposit varies by Property and will be specified on the RA.
Security Deposit and Renter's Obligations With Regard to the Property.
A security and damage deposit is required for any damage to the Property incurred during the term of your rental, or with respect to any items missing from the Property. Security deposits can be made in the form of Cash (Euros or USD), USD$ Check (sent to our office), or Credit Card Authorization Form.* At the end of the Renter's occupancy, the Property will be examined by the Greeter upon check-out and again in detail during the cleaning immediately following Renter's stay in the Property, before subsequent renters occupy the Property. Renter acknowledges that in certain cases, damage may be overlooked by the Greeter and subsequently found by the cleaner. Any damages, whether noted by the Greeter or cleaner, will be evidenced by proper documentation, including photographs where possible. Haven in Paris agrees to present a bill for any charges relating to damages incurred, if applicable.
For security deposits by check and via credit card, Haven in Paris reserves the right to retain the deposit until the Property has been verified both by the Greeter and the cleaner, as detailed above.
For security deposits in cash, damages will be deducted directly at check-out when applicable. If damages exceed the amount of the cash deposit, Renter is liable for the full cost of the damages and agrees to pay the full amount. If the cash deposit is returned at check-out and damages are subsequently noted during the final cleaning, as detailed above, Renter is required to pay for any damages incurred.
During the Term of this Agreement, the Renter shall keep and maintain the Property in clean and secure condition and Renter must leave the Property in the same condition as upon Renter's arrival, excluding normal wear and tear. It is understood and agreed that the Security Deposit shall be used to cover the cost of any damage to, or loss of contents of, the Property and the building of which the Property is a part (if any).
In the event that the costs of cleaning and/or replacement exceed the Security Deposit, the Renter agrees to pay the balance due via cash, credit card, check or wire transfer no later than five (5) business days following notice by HiP.
* Note: In Provence & Tuscany, the security deposit must be given in Cash (Euros) upon arrival.
Occupancy
Renter agrees that the number of people occupying the Property at one time will not exceed the maximum occupancy number indicated on this RA.
Group size is determined at time of reservation and is indicated above. Neither Haven in Paris nor Owners are responsible for any problems arising during a rental in which the number of persons occupying the Property exceeds the maximum occupancy provided herein.
If extra people will be occupying the Property, the Renter must notify Haven in Paris immediately, and pay any applicable extra fees. Extra person fees are applied per person per week or any part thereof.
The Renter will personally occupy the Property for said dates and shall not sub-let the Property under any condition.
Renter agrees to be quiet and respectful of neighbors at all times. This includes no excessive noise in the Property, stairwells, elevators, or building entry. People living here are not on vacation. Please behave as you would in your own home.
Smoking
Renter agrees not to smoke or allow visitors to smoke inside the Property or in the common areas of the building of which the Property is a part*. We do our best to provide completely non-smoking properties and thank you for your consideration.
* Feel free to smoke on the balcony, in the garden or in the courtyard (when indicated as permissible by notice at the Property).
Cancellation by Client
In the event of a cancellation, ALL sums paid to Haven in Paris as of the date of such cancellation shall be forfeited unless Haven in Paris is able to re-rent the Property for the same period (or part of said period), in which event the new amounts paid, less a 20% administrative fee will be refunded to the Renter. Please note that any change in rental dates becomes a new rental arrangement.
Cancellation Insurance
Cancellation insurance is the renter's personal responsibility, and we strongly recommend that you purchase insurance for your trip. We cannot be held responsible for a cancellation for ANY reason, whatever it may be. It is hard to believe it will happen to you, but sometimes life has a way of changing our plans for us. Please protect yourself against the unknown, we can not insist strongly enough.
If you would like to take out insurance for your trip, we recommend that you review the options available on sites such as:

These websites allow you to compare the plans offered by reputable travel insurance groups. Haven in Paris is in no way affiliated with any of these companies and these are merely suggestions. We suggest you shop around and compare until you find a product that best suits your needs.
Cancellation by Haven in Paris
In the unlikely event that Haven in Paris is unable to provide you with the Property originally booked, we reserve the right to offer you:
- A property of equal or greater value in exchange. If the property is of greater value, you will be asked to pay the difference between the new price and your original booking price OR if this is unacceptable, you will be given a 100% refund
- If the only property available is a smaller property of lesser value, you will be given the choice of taking it with a refund for the difference in price from your original booking OR if this is unacceptable, you will be given a 100% refund
- If nothing is available for your dates, we will cancel the booking and immediately issue you a full refund
Possible reasons for cancellation by Haven in Paris would include but shall not be limited to: damage to the Property, flooding, fire or major construction on building or environs.
It is also understood that Haven In Paris may terminate this Agreement upon two (2) days notice via email, fax or telephone to the Renter in the event of the nonpayment of the Rental Payment due hereunder.
Lost Key
If you lose the key to the Property, for your security, we are usually required to change the locks for the safety of everyone concerned. Renter agrees to pay this cost. A bill will be provided before your credit card is charged. It is often quite expensive (500 - 1200 Euros depending on specific lock) to change locks in Europe. Please be very careful with keys.
Renter agrees to inform Greeter, Haven in Paris, Owner or Owner's representative immediately of any damage that occurs on the Property during Renter's stay.

Equipment Breakdowns
Haven in Paris and the Owner cannot be held responsible for any breakdown of mechanical equipment in the Property or any common areas of the building of which the Property is a part (for example: heat, elevator, electricity), nor for failure of public utilities (for example: water, gas, cable, electricity). Please alert Greeter or Haven in Paris of any problem AS SOON as it is identified. Every effort will be used to rectify it in a timely manner. If we are not informed of a problem we cannot resolve it for you! If you feel that the matter has not been resolved in a reasonably timely manner, please contact Haven in Paris by telephone or email.
Internet Computer Note: In all Paris properties, a computer is provided for your use, in addition to a working high speed internet connection with Ethernet cable and/or a wireless network. Haven in Paris and the Owner will do their best to maintain said equipment in good working condition. If you wish to connect your computer to our network, please have all of the connection codes and information necessary for you to connect your specific computer. We will have the necessary WIFI codes available for you. Haven in Paris and the Owner cannot be responsible for the Renter's inability to connect to a working Internet connection. If this were to occur, we can provide the name of a computer tech person who can set up the connection for you, at your own expense.
Please note: Internet connections in Europe are not always reliable. Haven in Paris and the Owner cannot be held responsible for a non-functioning Internet connection (or computer**), but will use all means possible to remedy the problem as soon as possible.
**If computer use is essential during your stay in the Property, we suggest that you bring along your own as we would not want your stay to be ruined due to the malfunction of the computer in the Property.
For rentals in Provence and Tuscany, please inquire and we will let you know what kind of connection is in the villa, and whether there is a computer available for your use.
Cleaning
The Property will be thoroughly clean when you arrive and we ask that you leave it tidy when you depart. If upon arrival there is any issue of cleanliness, PLEASE NOTIFY the Greeter and/or Haven in Paris as soon as possible so that the situation can be resolved immediately.
There will be a final cleaning after you have checked out, but if the property has been left in such a condition that the cleaning is unusually time consuming, you will be required to pay for any time over the standard cleaning duration.
Release, Indemnification and Liability insurance
Absent the gross negligence or willful misconduct of Haven in Paris or Owner, the Renter agrees to fully release Haven in Paris (and its owners, employees and agents) and Owner (and Owner's owners, employees and agents) from any and all claims (whether they be in contract, tort, or otherwise) liability, loss or cost relating to any loss or damage to any property or person arising in connection with the Property or Renter's occupancy thereof. Renter understands and agrees that Renter is obligated to purchase personal or travelers insurance to cover any such damage or injury.
Renter understands that all valuables left in the Property are done so at Renter's own risk. All measures have been taken to ensure that the rental property is secure, but it is Renter's responsibility to make sure proper precaution is taken against theft and burglary.
In addition, Renter agrees to indemnify Haven in Paris (and its owners, employees and agents), Owner (and Owner's owners, employees and agents) for all loss, costs, expenses, direct or indirect damages, punitive damages or any other liability incurred by said parties resulting from any act or omission by Renter in connection with this rental.
In the event a court has determined that Haven In Paris and/or Owner has any liability hereunder, such liability shall be limited to the total fees paid by Renter to Haven in Paris pursuant to this Rental Agreement.
Jurisdiction
This contract is governed by the laws of the Commonwealth of Massachusetts. Courts in Massachusetts have exclusive jurisdiction over any claims, disputes, or other matters in question between the parties. In the event of litigation, the party found to be in breach of this Agreement shall pay all court costs & reasonable attorney's fees for the non-breaching party.
Invalid Provisions
In the event that any part or provision of this Agreement shall be determined to be invalid or unenforceable under the laws of the Commonwealth of Massachusetts, the remaining portions of this Agreement which can be separated from the invalid, unenforceable provisions and shall nevertheless continue in full force and effect.
Voluntary Execution
Each party acknowledges that they (with the intent to become legally bound by executing this Agreement) fully understand the Agreement and its legal effect, and that this Agreement may be signed only by Renter as a Unilateral Contract. Such party is signing the Agreement freely and voluntarily. For purposes of this Agreement, a "Unilateral Contract" shall be defined as binding upon the following act; payment made by Renter and acceptance of same by Haven in Paris in anticipation of the fulfillment of each party's obligations hereunder.
Each party should consult an independent attorney to ensure that the party's rights have been protected. Each party also acknowledges that the party is not relying on any representations made by a representative of the other party concerning any aspect of this Agreement.
Immediate Force and Effect
This Contract shall be in force and effect immediately upon its execution.

Miscellaneous
This Agreement constitutes and contains the entire agreement of the parties hereto with respect to the subject matter hereof and supersedes any and all prior negotiations, correspondence, undertakings, representations, warranties and agreements between the parties respecting the subject matter hereof. All exhibits referred to herein are incorporated by reference as if fully set forth in this Agreement. The headings contained in this Agreement are for reference purposes only and shall not affect in any way the meaning or interpretation of this Agreement. This Agreement shall be binding upon and shall enure to the benefit of the parties hereto and their respective successors and assigns, shall be governed by and construed and interpreted in accordance with the laws of the Commonwealth of Massachusetts, and may be amended from time to time only by a writing signed by both parties.
HAVEN IN PARIS PRIVACY STATEMENT
- Protecting the privacy of our clientele is extremely important to Haven in Paris. This is an obligation that we take very seriously. We are committed to protecting all of your personal information.
- At Haven in Paris we will never release your personal data, such as your name, address, phone number, email address, etc without your consent. We do not rent, sell or distribute any part of your information collected to any third party organization.
- We only use your information to complete your orders and for our own personal statistics (which we do not give to anyone).
- All credit card information is kept confidential and safeguarded by our secure server.
